1. General Provisions
1.1 ODAXY Labs LLP (hereinafter - “ODAXY Labs”) offers the Internet user (hereinafter - the “User”) - to use its services (mobile applications, website, and other resources provided by ODAXY Labs, including Teleteka applications and web sites) on the terms set forth in this User Agreement (hereinafter - "UA"). The Agreement takes effect from the moment the User expresses consent to its terms in the manner expressed by clause 1.3 of the UA.
1.2 The use of services provided by ODAXY Labs is governed by this UA, as well as documents that may form part of this agreement: the Privacy Policy for a specific service provided by ODAXY Labs, as well as the terms of use of individual services (if such are required in individual cases). The Agreement may be changed by ODAXY Labs without any special notice, the new version of the UA comes into force from the moment it is posted on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Agreement. 1.3 By starting to use any service / its individual functions, or going through the registration procedure, the User is considered to have accepted the terms of the UA in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the UA, the User is not entitled to use the services provided by ODAXY Labs. If ODAXY Labs has made any changes to the Agreement with which the User does not agree, User must stop using the services provided by ODAXY Labs.
2. User registration. User account
2.1 In order to use some of the services provided by ODAXY Labs, or some individual functions of the services, the User must complete the registration procedure, as a result of which a unique account will be created for the User. A user who has reached the age of majority (or if this does not contradict the law, then at an earlier age), has the right to independently register an account and use the services provided by ODAXY Labs within the legal capacity established by applicable law. If the User has not reached the specified age, as well as in cases where this is required by applicable law, the use of services is allowed only with the consent of parents or other legal representatives. Certain services provided by ODAXY Labs may establish other age restrictions, which may additionally be indicated in legal documents, or in the interface / description of the site, application and / or other service or software product.
2.2 For registration, the User undertakes to provide accurate and complete information about himself on the issues proposed in the registration form, and to keep this information up to date.
2.3 ODAXY Labs reserves the right at any time to require the User to confirm the data specified during registration in the User's account on the services provided by ODAXY Labs, and containing information about the User, as well as other information related to the use of services provided by ODAXY Labs, available to the User after authorization using the User's login and password on the services provided by ODAXY Labs (its affiliates).
2.4 The user is solely responsible for the security (including resistance to guessing) of the means chosen by him to access the account, and also independently ensures their confidentiality. The User is solely responsible for all actions (as well as their consequences) within or using the services provided by ODAXY Labs under the User's account, including cases of voluntary transfer by the User of data to access the User's account to third parties under any conditions (including under contracts or agreements). In this case, all actions within or using the services provided by ODAXY Labs under the User's account are considered to have been performed by the User himself, except for cases when the User, in the manner prescribed by clause 2.5., Notified ODAXY Labs about unauthorized access to services provided by ODAXY Labs, using the account User records and / or any violation (suspicion of violation) of the confidentiality of their account access means (email address, password or other information).
2.5 The User is obliged to immediately notify ODAXY Labs about any case of unauthorized (not authorized by the User) access to services provided by ODAXY Labs, using the User's account and / or about any violation (suspected violation) of the confidentiality of his account access means. ODAXY Labs is not responsible for any possible loss or corruption of data, or any other consequences of any character that may occur due to violation by the User of the provisions of this part of the UA.
2.6 The User does not have the right to reproduce, repeat and copy, sell and resell, as well as use for any commercial purposes any part of the ODAXY Labs services (including content available to the User through the services), or access to them, unless The user has received such permission from ODAXY Labs, or when it is expressly provided for by the UA of any service.
2.7 Termination of Registration. ODAXY Labs has the right to block or delete the User's account, as well as deny access using any account to certain ODAXY Labs services, and remove any content without giving reasons, including if the User violates the terms of the Agreement or the terms of other documents provided for p. 1.2. Of the Agreement, as well as in case of non-use of the corresponding service, in particular:
2.8 Any user account and / or his data can be deleted if the User has not used it for more than 6 months.
2.9 The user has the right at any time to delete her account on the services provided by ODAXY Labs.
3. Intellectual property rights
3.1 All objects available through the services provided by ODAXY Labs, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds and other objects (hereinafter referred to as the content of services), as well as any content hosted on services provided by ODAXY Labs are subject to the exclusive rights of ODAXY Labs, Users, and other copyright holders.
3.2 The use of content, as well as any other elements of services, is possible only within the functionality offered by that or another service. No elements of the content provided by ODAXY Labs, as well as any content posted on the services provided by ODAXY Labs, may not be used in any other way without the prior permission of the copyright holder. By use is meant, including: reproduction, copying, processing, distribution on any basis, display in a frame, etc. The exceptions are cases directly provided for by the legislation of the Republic of Kazakhstan (hereinafter "RK") or the terms of use of one or another service provided by ODAXY Labs. The use by the User of elements of the content of the services, as well as any content for personal non-commercial use, is allowed provided that all protection marks of copyright, related rights, trademarks, other notices of authorship are preserved, the name (or pseudonym) of the author / name of the copyright holder is preserved unchanged, keeping the corresponding object unchanged. The exceptions are cases directly provided for by the legislation of the Republic of Kazakhstan or by the user agreements of one or another service provided by ODAXY Labs .
4. Third party resources and content
4.1 ODAXY Labs Services may contain links to other sites on the Internet (third party sites). These third parties and their content are not checked by ODAXY Labs for compliance with certain requirements (accuracy, completeness, legality, etc.). ODAXY Labs is not responsible for any information, materials posted on third-party sites to which the User gains access using the services, including for any opinions or statements expressed on sites, mobile applications, or other resources of third parties, advertising etc., as well as for the availability of such sites or content and the consequences of their use by the User.
4.2 Service and Support. If, during the provision of technical support to the User, ODAXY Labs (its employees, or representatives) made any changes to the user account (with his verbal or written consent), or to the content provided by the User (which is available to the User), then the User is obliged to check this content, and accept full responsibility for its content , or delete it himself .
4.3 Services provided by ODAXY Labs use third party services that declare their own Terms of Use. This list may not be complete and may not be used in all services provided by ODAXY Labs, and is provided for the User's review. 5. Limitation of Liability
5.1 The user uses the services provided by ODAXY Labs at his own risk. The Services are provided “as is”. ODAXY Labs does not accept any responsibility, including for the compliance of the services with the goals of the User.
5.2 ODAXY Labs does not guarantee that: the services meet / will comply with the User's requirements; services will be provided continuously, quickly, reliably and without errors; the results that can be obtained using the services will be accurate and reliable and can be used for any purpose or in any capacity (for example, to install and / or confirmation of any facts); the quality of any product, service, information, etc., obtained using the services will meet the expectations of the User.
5.3 Any information and / or materials (including downloadable software, letters, any instructions and manuals for action, etc.), access to which the User obtains using the services provided by ODAXY Labs, the User can use at her own risk, and is solely responsible for the possible consequences of using the specified information and / or materials, including for damage that this may cause to the User's device or third parties, for data loss, or any other harm.
5.4 ODAXY Labs is not responsible for any types of losses incurred as a result of the User's use of the services provided by ODAXY Labs or individual parts / functions of the services.
5.5 The user is not allowed to copy or modify in any way the application, any part of it or the trademarks of ODAXY Labs. The user is not allowed to attempt to extract the source code of the application, nor should he attempt to translate the application into other languages, or create derivative versions. The services themselves, and all trademarks, copyrights, database rights, and other intellectual property rights associated with it, continue to belong to ODAXY Labs.
5.6 ODAXY Labs does not promise to always update its services and keep them up to date. However, you promise to always accept service updates when offered to you as a User. ODAXY Labs may also stop providing its services, without notifying you of the termination. Unless ODAXY Labs informs you otherwise, upon any termination: the rights and licenses granted to you under these terms will terminate; you, as a User, must stop using the services and (if necessary) remove it from your device.
6. Other provisions
6.1 This Agreement constitutes an agreement between the User and ODAXY Labs regarding the procedure for using the services, and supersedes all previous agreements between the User and ODAXY Labs.
6.2 This Agreement is governed by and construed in accordance with the legislation of the Republic of Kazakhstan. Issues not regulated by this Agreement are subject to resolution in accordance with the legislation of the Republic of Kazakhstan. All possible disputes arising from the relations regulated by this Agreement are resolved in the manner prescribed by the current legislation of the Republic of Kazakhstan, according to the norms of the law of the Republic of Kazakhstan. Throughout the text of this Agreement, unless clearly indicated otherwise, the term "legislation" means both the legislation of the Republic of Kazakhstan and the legislation of the User's place of residence.
6.3 With regard to the services provided under this Agreement on a free of charge basis, the rules on consumer protection provided for by the legislation of the Republic of Kazakhstan may not be applicable to the relationship between the User and ODAXY Labs.
6.4 If the services provided by ODAXY Labs provide the possibility of a paid subscription or other type of payment by the User, then the payment for it is made by the User in advance.
6.5 Nothing in the Agreement can be understood as the establishment between the User and ODAXY Labs of an agency relationship, partnership relationship, joint activity relationship, personal employment relationship, or any other relationship not expressly provided for in the Agreement.
6.6 If, for one reason or another, one or more of the provisions of this Agreement are found invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions of the Agreement.
6.7 Inaction on the part of ODAXY Labs in the event of a violation by the User or other users of the provisions of the Agreements does not deprive ODAXY Labs of the right to take appropriate action to protect its interests later, and does not mean that ODAXY Labs waives its rights in the event of subsequent similar or similar violations.
6.8 This Agreement was originally written in Russian, and in some cases it may be provided to the User for review in another language. In the event of a discrepancy between the Russian-language version of the Agreement and the version of the Agreement in another language, the provisions of the Russian-language version of this Agreement shall apply.
